The Union asserts that arbitrator AR 690-300, sub-chapter 335, (Annex 2), “has misinterpreted that a worker cannot be promoted competitively to a higher position – if he performs these functions.” Exceptions to 1. The Union recalls that the descriptions of the positions covered by Article 26 of the parties` agreement should reflect the tasks that a worker receives. In addition, under Article 11, when a worker performs more important duties, he or she should be detailed and promoted “if the obligations are renewed.” Id. to 2. The Union argues that the Agency did not dispute the fact that the victim had performed the tasks previously assigned to a GS-14 staff member, and these testimonies confirmed this fact. According to the Union, the management witnesses who testified at the arbitration hearing were not aware of the victim`s position or duties and had not been able to determine whether the victim had been treated unfairly. The Union acknowledges that, although the Agency has presented exhibitions in support of its position, the Union has presented exhibitions contrary to those of the Agency. According to the Union, the arbitrator “came with his own opinion regardless of what the facts and witnesses reported.” Id. at 1. Southern is the first black university or the first university to have such an agreement with Boeing.
Executive Order (EO) 13836, Developing Efficient, Effective, and Cost-Reducing Approaches to Federal Sector Collective Bargaining, signed by the President on May 25, 2018, requires agencies to submit any long-term collective agreement (CBA) and its expiry date within 30 days of the CBA`s entry into force. EO 13836 also requires OPM to make these CBAs available to the public on the internet. This promotes transparency by allowing the public to consult the types of agreements between federal agencies and industry unions. Agencies are also required to submit arbitration awards to OPM within 10 business days of receipt. OPM has issued a memorandum on the publication of the CBA database, which contains guidelines on agency requirements for CBAs and arbitration awards.
